About the course
This course will provide students with an overview of the salient aspects of employment law applicable at each stage of the life cycle of the employment relationship. This will include the theory, key pieces of legislation and relevant case law to highlight the practical application of employment law to the employment relationship. The course will enable delegates to understand the legal environment within which the employment relationship exists.
This course is suitable for HR professionals who advise line managers on a range of employee issues, line managers who want to further understand the mutual obligations of the employer and employee, business owners who do not have a HR function and need to understand their obligations under employment law, HR professionals who work in the US or UK and have responsibility for an Irish operation/ subsidiary.
Students will gain a greater understanding of the many legal facets of the employment relationship and will be able to understand the legal obligations of managing the employment lifecycle from inception to end, and identify and minimise problems that arise throughout the course of the employment lifecycle.
Part 1 – The Beginning
Subject Areas: Advertising, Applications, Screening, Interviewing, Selection, Offer of Employment, Medicals, References, Employee Handbook
The Legal Issues: Employee v Independent Contractor, Employment Equality Acts, Data Protection Acts, Fixed Term Worker, Part Time Worker, Contract Law, Common Law, Constitution, Terms and Conditions of Employment, Implied and Express Terms, Collective Bargaining
Part 2 – Normal Lifecycle Events
Subject Areas: Hours of Work, Leave Types, Leave Requests, Wages/Salary, Performance Reviews, Promotions & Transfers, Communication/Consultation, Privacy and Confidentiality
The Legal Issues: Working Time Limits, Maternity/Parental/Adoptive/Carer’s Leave, Annual Leave/Public Holidays, Authorised v Unauthorised Leave, Provision of Information, Variation of the Contract of Employment
Part 3 – Conflict in the Workplace
Subject Areas: Grievances, Complaints of Bullying/Harassment/Sexual Harassment, Performance Management, Absenteeism/Ill Health, Discipline, Whistle-blowing
The Legal Issues: Codes of Practice, Investigations, Proper and Fair Procedures, Health and Safety, Stress/Occupational Injury, Unfair Dismissal Acts, Mediation, Human Rights
Part 4 – The End of the Employment Relationship
Subject Areas: Resignation, Cessation of Contract Purpose, Dismissal, Redundancy, Transfer of an Undertaking
The Legal Issues: Contractual Obligations – Covenants, Fixed Term Workers, Notice Periods, Actual v Constructive Dismissal, Fair/Unfair Dismissal, Wrongful Dismissal
Part 5 – Dispute Resolution post Termination
Subject Areas: Mediation, Statutory Bodies, The Courts
The Legal Issues: Unfair Dismissal, Breach of Contract, Judicial Review, Injunctions, Damages
A pass grade on the written assignment will be required for awarding of the Diploma. A fail grade will result in a Certificate of Attendance for the course but without the Diploma being awarded.
Students must attend at least 80% of classes to graduate with either the Diploma or Certificate of Attendance unless a serious and verifiable reason for further absence is provided. If completing the course online, attendance and participation is tracked through Moodle.
The assignment/project must be handed in on the due date unless a sound reason for lateness is provided. In such instances, an extension may be awarded at the discretion of the lecturer.
Successful students will be invited to attend a graduation event in Dublin in April 2020.
Dominic Wilkinson Barrister-at-Law FCIPD FCIArb MIITD
Dominic is a practising Barrister and has specialised in the area of employment law and dispute resolution. He holds post graduate qualifications in Arbitration Law and Human Resource Management. He also works as a HR Consultant. He has worked with a range of organisations, unionised and non-unionised, in the public and private sector in Ireland and the UK. He has delivered lectures and training seminars and has published articles on a range of employment topics.
