Learn the dynamic discipline of alternative dispute resolution (ADR)
This programme provides participants with an excellent grounding in the dynamic discipline of alternative dispute resolution (ADR). The course focuses on three key components of ADR, mediation, arbitration and conciliation. Particular emphasis is placed on the practical application of ADR techniques within professional and industrial contexts. Participants will study the various forms of ADR in terms of their processes, procedures and appropriate uses. The course will address the role of ethics in the use of ADR. Consideration is also given to how to participants can establish an ADR program in their own work environments and how they can integrate ADR language into legal and business contracts.
Week 1: Introduction to ADR, ADR vs. litigation.
Week 2: ADR approaches, advantages and disadvantages of each and the role of lawyers
Week 3: Mediation: The Dynamics of Conflict, Personal style & Types of Mediation
Week 4: Mediation: Workplace & Family Mediation
Week 5: Complex Mediation: Multi Unit Developments
Week 6: Introduction to Arbitration
Week 7: Arbitration: Regulation & infrastructure of arbitration, The Arbitration agreement
Week 8: The Arbitration Tribunal & Specialist Arbitration
Week 9: Other forms of ADR: Conciliation, negotiation & adjudication.
Week 10: Cast studies of examples of ADR in recent years
Dominic Wilkinson Barrister-at-Law FCIPD FCIArb MIITD
Dominic is a practising Barrister and has specialised in the area of employment law and dispute resolution. He holds post graduate qualifications in Arbitration Law and Human Resource Management. He also works as a HR Consultant. He has worked with a range of organisations, unionised and non-unionised, in the public and private sector in Ireland and the UK. He has delivered lectures and training seminars and has published articles on a range of employment topics.
This programme aims to develop student’s knowledge and understanding of alternative dispute resolution as it applies to everyday situations. Students will learn about the different options within ADR including mediation, arbitration and conciliation as a means to resolve conflicts without recourse to litigation. Students will also develop practical skills and be aware of communication as a key tool in litigation avoidance. At the end of the course, students will be familiar with the alternatives to litigation and the relative benefits of each. Students will also have an appreciation of the systems and structures involved in mediation and arbitration and have experienced a mock mediation scenario to practice implementing the skills they have gained over the ten weeks.
A pass grade on the written assignment will be required for awarding of the Diploma. A fail grade will result in a Certificate of Attendance for the course but without the Diploma being awarded.
Students must attend at least 80% of classes to graduate with either the Diploma or Certificate of Attendance unless a serious and verifiable reason for further absence is provided. If completing the course online, attendance and participation is tracked through Moodle.
The assignment/project must be handed in on the due date unless a sound reason for lateness is provided. In such instances, an extension may be awarded at the discretion of the lecturer.
Successful students will be invited to attend a graduation event in Dublin in April 2020.
